1. Acceptance of Terms

Welcome to Fixlify! These Terms of Service ("Terms") govern your access to and use of the Fixlify mobile application and web platform (the "App") provided by Fixlify AI ("we," "our," or "us").

By downloading, installing, or using the Fixlify App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Fixlify is a field service management platform designed for businesses to:

• Manage service jobs and work orders
• Track technician locations and assignments
• Communicate with clients via SMS, email, and voice
• Create estimates and invoices
• Document jobs with photos and files
• Track time and mileage
• Manage client relationships
• Collaborate with team members
• Access business analytics and reports

3. Eligibility

• Age: You must be at least 18 years old to use the App
• Business Use: Fixlify is intended for business and professional use by field service companies
• Authorization: If using on behalf of an organization, you must have authority to bind that organization

4. User Accounts

4.1 Account Types and Roles

• Admin: Full access to all organization features and settings
• Manager: Can manage jobs, clients, team, and view reports
• Dispatcher: Can create and assign jobs, limited editing capabilities
• Technician: Can view and update assigned jobs, track time and location

4.2 Account Security

• You are responsible for all activity under your account
• Do not share your login credentials
• Use a strong, unique password
• Notify us immediately at care@fixlify.app of any security breach

5. Prohibited Conduct

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Attempt to gain unauthorized access to our systems
• Reverse engineer or decompile the App
• Distribute malware or harmful code
• Upload illegal, harmful, or offensive content
• Overload, disrupt, or impair our systems
• Share account credentials or access unauthorized data

Violation may result in immediate account termination and legal action.

6. Location Tracking

The App requests location access for job dispatch, mileage calculation, and routing optimization.

• Background location is primarily for Technician role users
• You can disable location tracking in app settings
• Disabling may limit functionality (automatic job assignment, mileage calculation)
• Your location is visible to dispatchers and managers in your organization

7. Content and Intellectual Property

7.1 Your Content

You retain ownership of content you upload. By uploading, you grant us a limited license to store, process, display, and transmit your content to provide the service.

7.2 Our Intellectual Property

The Fixlify App, including software, designs, logos, and trademarks, is owned by Fixlify AI and protected by intellectual property laws. You may not copy, modify, or distribute our software.

8. Payment Terms

• Subscription fees are billed according to your plan
• Fees are non-refundable except as required by law
• Subscriptions automatically renew unless cancelled
• Failure to pay may result in service suspension

9. Service Availability

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• The App is provided "AS IS" and "AS AVAILABLE"
• We may modify, update, or discontinue features with notice
• Scheduled maintenance may cause temporary downtime

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXLIFY AI SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or downtime
• Data loss or corruption
• Unauthorized access or security breaches

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Fixlify AI from any claims arising from your use of the App, violation of these Terms, or infringement of third-party rights.

12. Termination

• You may terminate by contacting your administrator or emailing care@fixlify.app
• We may suspend or terminate for Terms violations or illegal activity
• Upon termination, your access ceases and data may be deleted after 30 days
• Export your data before termination if you wish to retain it

13. Dispute Resolution

Before filing a claim, you agree to attempt informal resolution by contacting care@fixlify.app. If informal resolution fails, disputes will be resolved through binding arbitration governed by the American Arbitration Association rules.

CLASS ACTION WAIVER: You agree to resolve disputes only on an individual basis, not as a class action or representative action.

14. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.
